PSA HAD NEVER ONCE QUESTIONED THE LEGALITY
OF THE APPOINTMENT OF THE PUBLIC SERVICE COMMISSIONERS (PSCs)

The PSA herewith confirms that we had never once questioned the legality of the appointment of the PSCs and still stands firm on our allegations regarding damages caused by the actions and decisions of the PSCs hence PSA will continue with our boycott programme.

The PSA raised our concerns last year with regard to the capabilities of the PSCs to efficiently carry out their duties given that the Prime Minister had only “hand-picked” them for Cabinet’s endorsement. The Prime Minister in accordance with the Public Service Act has the power to appoint anyone to the Public Service including the PSCs and Public Servants. However, in order to select the best candidate for a position, there are procedures for appointments such as advertising and interviewing of candidates against set criteria for the selection of the best candidate for the position. Had the Prime Minister followed the appointment procedures, the PSA would not have raised their concerns regarding the PSCs capabilities last year even if they are the Prime Minister’s friends. The damages that their actions and decisions to the Public Servants, Public Service and the citizens of Tonga in the past 12 months since their appointment have proven the concerns raised by the PSA last year to be correct.

The Acting Secretary for the PSCs and also some of PSCs employers in the private sector have written to the PSA 3 weeks ago advising they will not submit to our demands for the PSCs to resign. We have informed them that our boycott programme still stands. Had the Prime Minister’s Office were so concerned with our boycott programme as noted from the lengthy announcement that have been repeatedly announced, they should have made the announcements 2 weeks ago.

The PSA believed that the Prime Minister’s Office made announcements repeatedly last Saturday and early this week as their attempt to redirect the attention of the public from our petition submitted to His Majesty, King George Tupou V, on Friday last week where we had recommended, amongst others, for the Prime Minister to be relieved from his position. We herewith confirm that we did not mislead our members as our benefits have been taken away and we are concern with the fact that our service delivery to the citizens of the country have declined because of the decisions made by the PSCs.

The announcement confirmed our allegations that the PSCs are not independent of Cabinet given they report to the Prime Minister who recommended their appointment and who is also the Head of Cabinet. And of course Government would be satisfied with what the PSCs has done because they we only following the directions of the Prime Minister and Cabinet.

The information regarding to our lost benefits, damages to the Public Service & the citizens of Tonga (students) and our boycott actions has been extensively debated in writing by the two parties, i.e. PSCs & PSA since March 2006 and no compromise was reached for the betterment of all. Government stoodfast in taking away our benefits whilst at the same time granting the benefits of the Army & Police and those in the higher levels in the Public Service as Cabinet believed that they are the only positions required to operate the Ministries in Government according to one of the replies from the PSCs. These benefits are part & parcel of the salary structure we had agree to in the MOU in 2005 to be used as the basis for our salary increases. There deferment and cancellation of our benefits in February, Cabinet breached one of the clauses in the MOU. If they had wanted to differ from our agreement in the MOU, i.e. to take the benefits away, they should have informed us. Had they informed us, we would have insisted that all the benefits for all employees in Government including the Army and Police be deferred and/or canceled.

Cabinet had never accepted our invitation for a meeting since March 2006 regarding our benefits and extension of the MOU. It was not until we submitted the report of our survey on the MOU on the 29th May, 2007 with recommendations therein for Cabinet to respond to by the 15th June, that the PSCs requested for a meeting. We had informed the PSCs that it is the Signatory (Cabinet) of the MOU with whom we wanted to meet. Cabinet have never written and informed us that the PSCs would represent them as the Signatory to the MOU. In order to avoid any industrial action because of the country’s already diminishing economy and the agreement between Cabinet and the Public Servants in the 2005 Memorandum of Understanding (MOU) that we move forwad in peace and good faith with respect, trust and fairness, the PSA had opted for a judicial review as we believe that our MOU have been breached when Government differed and/or canceled some our benefits.

Although Cabinet has now decided to return our benefits in this financial year (July), our benefits such as overtime and acting appointment last year is lost. Our concerns with regard to the insecurities of our pay rise are alsotrue, now in their announcement in the weekend Government admits that our salaries will be reviewed next year. So where is the permanency of the salary that the Prime Minister has announced on TV and radio on the 05th of June? He had purposely omitted to announce the complete decision of Cabinet made regarding our pay rise, i.e. that it will be review again next year. The current salary structure has a performance appraisal method but it was not effectively used by the Heads of Departments. So, what is the guarantee that the Heads of Department would implement the performance appraisal in the new salary structure?

It is a shame that the Prime Minister blamed the damages of most schools and the studies of the students to the Public Servants who volunteered under the redundancy programme. The PSA herewith confirms that there is a VOLUNTARY REDUNDANCY POLICY that sets out the procedures for implementing the programme. Had the PSCs followed these procedures, there would not have been any damages to most of the schools in Tonga and the studies of the students. The procedures of the Voluntary Redundancy Policy are as follows: (1) the PSC and the Ministry shall access the posts that are required to be abolished; (2) that the PSCs invites the Public Servant who is in the post to be abolished to volunteer to take the redundancy package; (3) if the Public Servant do not want to be made redundant, the PSC shall retrain the Public Servant and relocate to another post where he/she would be more productive so the the previous post could be abolished.

Instead of following the procedures, the PSCs had opened up to all Public Servants to volunteer which resulted in the abolishment of a lot of important posts such as principals and deputy principals, etc. hence the damages to thr schools and students. Now, the Prime Minister blamed the damages cause by the incapabiities of the PSCs to conduct their duties well on the innocent Public Servants who were made redundant.

If we conducted are responsibilities well in accordance to our job description than we have met the agreement we made with Government. But if Government failed to grant to us the benefits that we had agreed to if we conduct job responsibilities well, this caused the problems that we are having now. The PSA also confirm that our seeking our rights at work (i.e. our lost benefits) is not a political activity. Industrial actions made by the Public Servants may be new to Tonga but it is nothing new in the world. We have heard on the news of industrial actions made by Public Servants in overseas countries when their Employers took their benefits against their will or without their knolwdge. Industrial acitons is one of the tools that measure the performance of Employers. The PSA steps in to represents its members when they the official channel for submission of complains failed them. But on this issue, PSA strongly reaffirm that Cabinet has breached the MOU which included our benefits hence we do not need to use the official channel for submission of grievances. We had an agreement wth Cabinet in 2005 and it is Cabinet with whom we should deal with directly as we have been given the authority in the MOU by the former Interim Committee to represent the public servants who benefits from the MOU. Even if the Public Servants are not members of the MOU, it is our responsibility under the MOU to seek their views and 99.9% according to our survey early this year do not want their current pay rise to be changed.

We had also requested in the MOU for a Royal Commission to be established to undertake a Constitutional Review for a more democratic Government to be established and for the Royal Commission to report back to Government and to us before the 31st December 2005. We had followed up in December 2005 on this request and Cabinet has informed us that their agreement in Parliament for the establishment of the Parliamentarian National Committee for Policital Reform (PNCPR) to undertake public consultation on the political reform is their addressing our concerns. They had requested us to wait for the PNCPR report. As such, we are still following up this part of our agreement with Cabinet and now with His Majesty in our petition. The PSA also reminded Government that that Constitution supercedes all laws in Tonga including the Public Service Act.

The PSA wonders why it has taken 21 months for Cabinet to open the door for dialogue. The PSA confirms that we have been ready for dialogue in the past 21 months and would meet with Cabinet if (1) an official written invitation is given to us and (2) that the discussion will be made on the recommendations of our petition.
