We have demanded last Friday, 08th June, 2007 the resignation of the Chairperson of the Public Service Commission (PSC), Mrs. Mishka Tu’ifua, who is also the General Manager of the Westpac Bank of Tonga by the end of this month. We have also demanded the resignation of the other two Commissioners of the PSC namely, Mrs. Tai’atu ‘Ata’ata, Marketing Manager of the Tonga Communication Corporation; and Mr. Ross Chapman, Shareholder of the Office Equipment, Pacific Hardware Timber and Dateline Transam Shipping.
The 3 Commissioners were appointed by Cabinet last year upon the recommendation of the Prime Minister, Dr. Feleti Sevele, who is a personal friend to all the Commissioners hence he did not apply to them the normal recruitment process of Government (i.e. advertise & interview the positions. He followed the use of absolute power as used by the King in appointing his Cabinet Ministers). The Chairperson and Commissioners currently receives a salary of T$800.00 and T$600.00 per month respectively excluding meeting fees from Government, despite the fact that the Prime Minister had announced to the public when the Commissioners were appointed last year that the Commissioners are not paid by Government.
The PSA believes that the Commissioners since their appointment have not acted in the best interest of the Public Service and the Public Servants of the Government of Tonga. Rather they have only acted to please the person who has recommended their appointment, the Prime Minister of Tonga, Dr. Feleti Sevele. Enclosed please find copies of our letter to the Commissioners and their respective Employers and/or Shareholders detailing therein their referred actions/decisions for your information.
If the Commissioners will not resign by the end of this month, we would be forced to boycott the businesses they work for or own, namely the Westpac Bank of Tonga, Tonga Communication Corporation, Office Equipment, Pacific Hardware Timber and Dateline Transam Shipping

Dear Commissioners,
Subject: Demand for Resignation from the Public Service Commission
Reference is made to the above-stated subject, we herewith wish to advice that the PSA believed that from the decisions that you have done to date since your appointment to the Public Service Commission (PSC), you have acted only in the interest of the Prime Minister, your personal friend who has appointed you as Commissioners of the PSC, and not for the welfare of the Public Service and the Public Servants. These decisions are related to the following:
Early last year, instead of fighting for the rights of the Public Servants to be treated the same as the Army and Police and for fair distribution of Government’s benefits amongst its employees when the Prime Minister and Cabinet deferred and cancelled some of the Public Servants benefits (i.e. annual increments, acting appointments and promotions), you had taken sides with the Prime Minister and Cabinet without any effort to help the Public Servants. The PSA believes that this decision has breached the Memorandum of Understanding signed by the Public Servants and the Cabinet in 2005 which stated that there should be no discrimination against them hence we are taking Government to court on this matter for a judicial review.
Last year also, you had implemented the Voluntary Redundancy Programme in which more than 800 Public Servants were made redundant in July 2006. The PSA appreciates the principles of the redundancy programme if it was implemented with the proper procedures. However, the redundancy programme was implemented poorly as you did not undertake the assessment of the posts which were needed to be abolished properly. This resulted in the lost much needed posts in the Public Service, in particular the Ministry of Education. The performance of the Ministry of Education declined in 2006 as indicated by the decline in the exam results of most schools in Tonga given that most of the posts for principals and teachers were abolished affecting the students’ study programme, and especially when the redundancy programme was implemented in the middle of the year. You may recall the Friendly Islands Teachers Association (FITA), an affiliate of PSA, has requested for the redundancy programme for the teachers to be postponed to the end of the year because of the study programme of the students. You did not consider the welfare of the students in your strife to meet the demand of the person who appointed you.
At the time of the redundancy programme, the Ministry of Education was already short by about 150 teachers (the former Director of Education had stated this when you had sent out the invitation at the beginning of the programme) and yet you laid off more than 300 teachers in your desperate effort to reach the target of 1,000 Public Servants to be laid off which the Prime Minister had wanted. To date, most primary schools in Tonga are struggling to teach the students with only 3 teachers in one school with 6 levels, straining both the remaining teachers and the over crowded students. This was confirmed by the new Chief Executive Officer of Education early this year. It might help if you go out to the schools to witness what you have done. Who should we blame for the suffering you had imposed on the education of the young children of Tonga? The Prime Minister who appointed you or Cabinet who directed you to undertake the redundancy programme or you who implemented the programme poorly?
3. In February this year, you had suspended without pay for eleven(11) weeks our Secretary General, Ms. Mele ‘Amanaki, causing her and her family unnecessary financial hardship and damages to her reputation. Notwithstanding that our Secretary General was only carrying out her responsibilities as the secretary of the PSA, the Clause 7 of the Constitution of Tonga allows her to speak, write or print what ever is in her mind and no law in Tonga shall be enacted to stop this freedom forever, unless the laws for libel and the protection of the King is nullified. The emails sent out by our Secretary General nullify neither laws nor it would have cost Government more than T$1.00.
In addition to her constitutional rights as a Tongan, a similar case had occurred in 2005 in which the former Solicitor General, now the Minister of Justice, has been accused of committing an action against Government in 2005 (when she spoke in public to thousands of people encouraging about 90% of the Public Servants continue the strike despite Government’s calling for the Public Servants to return to work). His Majesty’s Cabinet, however, had settled this employment dispute without having to suspend or temporary suspend the contract of the former Solicitor General. Therefore, it is the opinion of the PSA that our Secretary General should not have been suspended without pay when you were considering your accusations against her. The PSA gives its full support to our Secretary General and will stand to justify in court accordingly if our Secretary General has to seek for her constitutional rights and compensation in court.
4. Upon her reinstatement to the Public Service and her salary during the period of her suspension reimbursed, our Secretary General found out that her cheque account in the Westpac Bank of Tonga (WBOT) in which her salary is directed to have an overdraft of approximately $230.00. This overdraft accounted for accumulated bank fees (loan deduction fees, automatic deduction standing order fees and bounced cheque fees) resulted from the suspension of her salary by your Commission in which the General Manager of the WBOT is the Chairperson. Without being aware of the bank fees, our Secretary General has over estimated the balance of her cheque account causing some of her cheques to be bounced. Although the WBOT has reversed the fees for the loan repayment and standing order deductions, our Secretary General was told to pay approximately T$155 for the bounced cheque fees which was caused by a decision made by the GM of the WBOT in her capacity as the Chairperson of the PSC. It is the opinion of the PSA that the Chairperson has neglected her responsibilities as the banker to her client, our Secretary General, in her efforts to please the person who appointed her to the PSC, the Prime Minister and Cabinet.
5. In our current effort to negotiate with Cabinet for the extension of our MOU, you are fully aware that you are not the Signatory of the MOU hence you had no part in this negotiation. However, instead of trying to help us to avoid any industrial action in the future causing disrupt to the Public Service or act as mediator on our behalf to bring our voice to Cabinet, you had acted only to serve the interest of the person who appointed you when you wrote to inform us of the instruction of Cabinet and the person who appointed you.
Your appointment from the private sector as Commissioners was meant for the PSC to be independent of Cabinet but it seems that Cabinet is still in full control of all your actions and decisions as clearly demonstrated above. It is of great concern to the PSA that you have acted only on behalf of the Prime Minister who appointed you as Commissioners and not for the betterment of the Public Service and the Public Servants given that your decisions as Commissioners are not independent of Cabinet as they should have been.
Given that your past actions and/or decisions stated above had affected majority of the Public Servants and had caused obvious decline in the performance of the Public Service, we demand your resignation from the Public Service Commission. If you do not resign from the Public Service Commission by the 30th June, 2007, we would boycott your respective businesses and/or businesses that employ you (i.e. Westpac of Tonga, Tonga Communication Corporation and Office Equipment, Pacific Hardware and Dateline Shipping) or even an industrial action if necessary as the last resort.
We hope that you will not take our request and warning lightly.

Therefore, we had demanded the resignation of your bank’s General Manager from her position as the Chairperson from the PSC by the end of this month. Enclosed please find the copy of our letter to the Chairperson detailing therein her actions which we believed to have affected the Public Service and the Public Servants for your information.
Kindly note that if the General Manager of your bank will not resign from her position as the Chairperson of the PSC by the end of this month, we would be forced to boycott your bank by moving the accounts of all our Members from your bank to another bank. You may also be aware that our Members, as Public Servants, are also Members of the Retirement Fund Board who invests more than T$6.5m in your bank.
Given the above, we herewith seek your kind assistance is requesting the General Manager of your bank, Mrs. Mishka Tu’ifua, to resign from her position as the Chairperson of the PSC by the end of this month.

I understand the connection between Chapman and Sevele. They are close friends and Chapman will receive benefits of the decisions that he makes of in terms of supplies to the government from his business interests. Keeping in mind that he has a number of tenticles that extend is all oriffices of the government.
I understand that Sevele's daughter is good friends with Tiatu from TCC.
But what is the connection between Sevele and Mishka? Do they have a connection or did they have a connection somewhere in the past that has resulted in Mishka getting this job.
Anyone know anything about their connections?

Yes I am aware that Mishka was very kind to Sevele with the loans regarding Sevele's export of Squash.
That was just prior to the time that Sevele was caught up in the payment to farmers for the squash that he bought from them...including his brother in law. To think that someone would take financial advantage of his own family members!
But did you ever consider why she (Mishka) was so generous? This was well before Sevele was the PM......Do you know of their prior connections?
